EngageBay does not sell personal information as defined under these laws. We also do not share personal information for cross-context behavioral advertising in a way that requires an opt-out under CCPA/CPRA or similar state laws.

This page allows you to understand and exercise your available privacy choices. We honor Global Privacy Control (GPC) signals where required by law.

2. Global Privacy Control (GPC)

We automatically detect and honor Global Privacy Control (GPC) signals sent by your browser or device. GPC is a browser-based preference signal that communicates your opt-out choice for the sale or sharing of personal information.

If you have enabled GPC (available in browsers such as Brave, DuckDuckGo, Firefox with extensions, or via privacy-focused settings), we treat it as a valid opt-out request where applicable under U.S. state privacy laws.

No further action is required from you if GPC is already enabled in your browser.

3. Opt-Out Confirmation and Status

We provide a way for you to confirm your opt-out status:

This confirmation mechanism complies with requirements under CCPA/CPRA and other applicable U.S. state laws to allow you to verify that your opt-out has been honored.

5. No Sale or Sharing of Personal Information

In providing the EngageBay email marketing platform, we act as a service provider/processor on behalf of our customers (the data controllers). We do not sell your personal information to third parties for monetary or other valuable consideration, nor do we share it for cross-context behavioral advertising purposes in a manner that triggers opt-out obligations under CCPA/CPRA or similar state laws.

Any transfer of data occurs solely for the purposes of providing our services (e.g., to subprocessors for hosting, email delivery, or payment processing) as detailed in our Data Processing Agreement (DPA).

6. Sensitive Personal Information

We do not collect or process sensitive personal information (as defined under CCPA/CPRA or similar laws, such as precise geolocation, health data, racial or ethnic origin inferences, or other categories) in a manner that would trigger the right to limit its use.

Our processing is limited to the categories described in our Data Processing Agreement (e.g., email addresses, names, engagement data, country-level IP geolocation). No additional limiting mechanism is required.

This page is provided primarily for residents of U.S. states that grant privacy rights related to the sale, sharing, or use of personal information (e.g., California, Colorado, Connecticut, Oregon, Texas, and other states with similar laws effective in 2026).
